These terms govern your use of sellyourboat.io and any white-label deployment operated under it. By using the service, you agree to these terms. If you do not agree, do not use the service.
1. The service
sellyourboat.io is a white-label boat listing platform operated by Wall and 5th Ltd, a company registered in England and Wales 16573579. We provide a listing submission wizard, a broker admin panel, and WordPress publishing tools.
2. Accounts
- Broker accounts are created by Wall and 5th Ltd on request.
- You are responsible for maintaining the security of your credentials.
- You must not share accounts, attempt to bypass authentication, or access accounts that are not yours.
- We may suspend or terminate accounts that breach these terms.
3. Listings and content
- Sellers submitting listings warrant that they have the right to list and sell the boat described.
- Brokers are responsible for reviewing and approving listings before publication.
- We may remove listings that appear fraudulent, unlawful, or in breach of these terms.
- Listings must not contain illegal, misleading, or infringing content.
4. Payments
- Subscription fees are charged per brand, per month, at the rates shown on our pricing page.
- Fees are billed in advance and are non-refundable except where required by law.
- We may revise pricing on 30 days’ notice; existing billing cycles are unaffected.
- Paid listing submissions (where applicable) are processed by Stripe under their terms.
5. Cancellation
You may cancel at any time with effect from the end of the current billing period. Cancellation does not automatically delete your data; deletion requests should be made in writing.
6. Intellectual property
- You retain ownership of content you upload. You grant us a non-exclusive licence to host, display, and transmit it for the purpose of operating the service.
- The sellyourboat.io name, logo, and platform code are the property of Wall and 5th Ltd. You may not copy, modify, or redistribute the platform.
7. Acceptable use
You must not:
- Use the service for unlawful purposes or to infringe any third party’s rights.
- Attempt to compromise security, scrape data, or reverse-engineer the platform.
- Send spam or unsolicited communications through the platform.
- Upload malware, illegal content, or content you do not own.
8. Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. Scheduled maintenance and unforeseen outages may occur. Enterprise customers may receive a service level agreement (SLA) under separate terms.
9. Liability
To the maximum extent permitted by law:
- The service is provided “as is” without warranties of any kind.
- We are not liable for indirect, consequential, or incidental losses, including lost profits or data.
- Our total liability in any 12-month period is limited to the fees paid to us during that period.
- Nothing in these terms limits liability for death, personal injury, or fraud where such limitation is not permitted.
10. Indemnity
You agree to indemnify Wall and 5th Ltd against any claims, losses, or damages arising from content you submit or from your breach of these terms.
11. Changes
We may update these terms. Material changes will be notified to broker account holders by email. Continued use after changes constitutes acceptance.
12. Governing law
These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
